We'd appreciate if you don't give copies to all your mates. A lot of time, effort and skill (oh, and a bunch of cash) has gone into making these photos available and we'd like to be able to offer this service again, safe in knowledge that most people do the right thing. Smaller versions of the photos will be available to all for free after the event.
For the purposes of this licence, the "Licensor" is David Sundstrom for images with a caption conatining "DSC". For all other images, the "Licensor" is Roger Barnes.
The Licensor offers Digital Photographs which the Licensor allows you to use in accordance with the terms of this Agreement. By ordering any Digital Photos you agree to be bound by the terms of this Agreement.
Licensor grants to you a non-exclusive, non-transferable right to use supplied Digital Photos from the Licensor as a part of materials for personal, non-commercial use. No other rights are granted except as specifically provided in this Agreement.
No Digital Photos or copies of them may be sub-licensed, resold or otherwise made available for use or distribution. Digital Photos may not be made available for download.
Warranties
Licensor makes no
warranty, express or implied, including, without limitation, any
implied warranties of merchantability or fitness for a particular
purpose. Licensor shall be liable to You or any other person or
entity for any general, special, direct, indirect, consequential,
incidental or any other damages arising out of this license or
otherwise.
Copyright and other
Intellectual Property Rights
All rights to the
Digital Photos are owned by Licensor and are protected by Australian
copyright laws, or the equivalent law in any country around the
world. Licensor retain all rights not expressly granted by this
agreement. The Digital Photos are licensed only to you. The
copyright and all intellectual property rights in and to the Digital
Photos are owned by Licensor. You agree not to assert any
intellectual property rights against Licensor now or in the future.
Termination
The license contained
in this Agreement will terminate automatically without notice from
Licensor if You fail to comply with any provision of this Agreement.
Upon termination, You must immediately:
(i) stop using the Digital Photos; and
(ii) delete any Digital
Photos and all copies of all of them from all digital media and
destroy all other copies or, upon request of Licensor, return all
copies of the Digital Photos to Licensor.
